Foreclosure Defense
A rapidly growing area of our practice is foreclosure defense. Foreclosure is the legal and professional proceeding in which a mortgagee, or other lienholder, usually a lender, attempts to have the Court order a sale of your home. You have the right to fight the foreclosure, but once upi are served with a summons and foreclosure complaint, you only have twenty (20) days to file an answer with the Court. It is important to contact an attorney before the expiration of that 20 day period to avoid a default being entered against you.
In many foreclosure actions, there are defenses that can be asserted on behalf of the property owners. More and more, attorneys are seeing examples of improper actions taken by lenders. Without hiring an attorney, you may not know whether the bank has followed all of the appropriate steps in both the loan itself, as well as the foreclosure process.
